Your right - you shouldn't have to go through this. what he is doing is illegal and you should definately try and convince your mum. you say you have evidence? use it to show your mum. try writing it down. how you feel, everythinng every time it happens and then show her how it makes you feel.

if hes doing that to you then it migh be better that your brother doesn't grow up with him around. hes probably going to be a bad influence and so in a way it would probably be better if he wasn't around.

Try and tell another adult like a teacher or someone you trust. a friend's parent maybe because adults can help you. they can make sure you are safe. you shouldn't have to grow up like this. home is where you should feel safe. what hes doing is illegal and its definately not your fault. i'm sure your mum wouldn't want you to grow up like this. she'd rather you were happy.

please tell someone and try and do something about it. for your sake and possibly others.
